Terms of service

    Preamble

    These terms and conditions of sale govern all sales made by B.fabers to consumers, within the meaning of the French Consumer Code, on the website bfabers.com.

    They are made available to the customer before the order is placed and their acceptance is obtained at that time. They prevail over any other document.

    Version in force as of 10 September 2026.

    Article 1 — Identification of the seller

    FABERS, a French société par actions simplifiée with a single shareholder and a share capital of 30,000 euros, trading under the name B.fabers, registered office at 20 rue Henri Dhennin, 59551 Attiches, France, registered with the Lille Métropole Trade and Companies Register under number 992 404 814, intra-community VAT number FR50 992404814.     Article 2 — The pieces

    The pieces offered are solid wood furniture, made to order in the workshop of an independent craftsman, numbered, and bearing a brass plate with the customer's name, fixed to the piece.

    No piece is held in stock. The order starts the work.

    Variations in the material. Solid wood is a living material. Differences in grain, shade and response to the finish between a delivered piece and the photographs on the website are inherent to the material and do not constitute a lack of conformity.

    Dimensional tolerances. Stated dimensions are subject to a manufacturing tolerance of plus or minus 0.5%, with a minimum of three millimetres. As solid wood is a living material, the dimensions of a piece also continue to vary slightly with the seasons, depending on the humidity of the room in which it lives. These variations are normal and do not constitute a lack of conformity.

    Wall-mounted pieces. The Nescio consoles, in all three variants, are fixed to the wall. They require a masonry support: concrete, brick or stone. A plasterboard partition is not suitable without appropriate reinforcement. The fixing system is made to measure for each piece by a partner metalworker. Installation instructions, specifying the fixings and the permissible load, are supplied with the piece. B.fabers recommends entrusting the installation to a professional and can arrange it, on request and on quotation.

    Essential characteristics. The essential characteristics of each piece, its wood species, finish, format, dimensions and price, appear on its product page, in accordance with Article L.111-1 of the French Consumer Code.

    Article 3 — Prices

    Prices are stated in euros, inclusive of all taxes and of the eco-contribution, and exclusive of delivery costs. The amount of the eco-contribution is shown on each product page.

    Delivery costs are shown before the order is finally confirmed.

    B.fabers reserves the right to change its prices at any time. Pieces are invoiced on the basis of the price in force at the time the order is recorded.

    Article 4 — Ordering

    An order follows these steps:

    1. selection of the piece, the wood species, the finish and the format;
    2. review of the summary, the total price and the delivery costs;
    3. entry of contact details and delivery address;
    4. acceptance of these terms and conditions of sale;
    5. confirmation of the order by means of a button explicitly stating the obligation to pay, in accordance with Article L.221-14 of the French Consumer Code;
    6. payment.

    The sale is concluded upon confirmation of payment. A confirmation email, summarising the order and reproducing these terms, is sent to the customer on a durable medium, in accordance with Article L.221-13.

    B.fabers reserves the right to refuse an order that appears abnormal, or that comes from a customer with whom a payment dispute is ongoing.

    Article 5 — Payment

    Payment is made online, by bank card or by any other means offered at the time of ordering. Payment data is processed by the payment provider and does not pass through B.fabers.

    Payment is due in full at the time of ordering, unless otherwise agreed in writing.

    Article 6 — Making and delivery times

    Making time. Making the piece takes up to sixteen weeks from the conclusion of the order, and generally ten to twelve weeks depending on the craftsmen's workload.

    Delivery time. Delivery then takes place within two weeks at most in mainland France, and four weeks at most for any other destination.

    Total time. The maximum time between order and delivery is therefore eighteen weeks in mainland France and twenty weeks elsewhere. This time is made known to the customer before the order, in accordance with Article L.111-1 3° of the French Consumer Code.

    Delay. In accordance with Article L.216-2 of the French Consumer Code, if this time is exceeded, the customer may terminate the contract by registered letter or in writing on another durable medium, after having required B.fabers to deliver within a reasonable additional period and in the absence of performance. The contract is then terminated upon receipt of that written notice and B.fabers refunds all sums paid within fourteen days at the latest of termination.

    Delivery costs. These are fixed amounts and depend on the size of the piece and on the destination.

    Zone 2: Belgium, Luxembourg, the Netherlands, Germany, Monaco. Zone 3: Spain, Italy, Portugal, Austria, Ireland, Denmark. Zone 4: the other member states of the European Union.

    The fixed amount for the tables and the writing desk covers delivery by two people, placing the piece in the room of your choice, unpacking, and removal of the packaging.

    Delivery is understood to be on the ground floor or with a lift. An upper floor without a lift, a narrow access or any other particular constraint gives rise to a supplement, quoted before the order is placed: please tell us about these conditions at maison@bfabers.com.

    Corsica, islands and destinations with particular access. Corsica, the French islands and certain addresses with particular access involve additional transport costs that the fixed amount does not cover. In such cases we contact you before starting the making of the piece and give you the exact amount. You are free to accept it or to withdraw: if you decline, the order is cancelled and refunded in full, with no charge and no waiting period.

    Delivery area. Online orders are delivered in mainland France and in the member states of the European Union. For any other destination, the customer is invited to send a request to maison@bfabers.com: a personalised proposal is then made, covering transport, customs formalities and applicable taxes.

    Arrangements. Delivery is carried out by a specialist carrier, to the address given by the customer. Access conditions, floor, lift and passage width, must be specified at the time of ordering; failing this, the cost of a second delivery attempt is borne by the customer.

    Transfer of risk. In accordance with Article L.216-4 of the French Consumer Code, the risk of loss or damage passes to the customer at the moment they take physical possession of the piece.

    Article 7 — Receipt of the piece

    The customer is invited to examine the piece on delivery and to report any visible damage within seventy-two hours, to maison@bfabers.com, with photographs.

    This report is intended to facilitate a claim against the carrier. It is not a condition of either the right of withdrawal or the legal warranties, which apply in any event.

    Article 8 — Right of withdrawal

    This article is set out in full in the returns, withdrawal and warranties policy, which forms an integral part of these terms and is accessible from the footer of the website.

    In short: an order may be cancelled freely for forty-eight hours. After that, the making of the piece has begun. As each piece is made to order and bears a brass plate with the customer's name, it falls within the exception provided for in Article L.221-28 3° of the French Consumer Code and cannot be the subject of a withdrawal.

    Article 9 — Legal warranties

    B.fabers is liable for any lack of conformity of the piece with the contract under the conditions of Article L.217-4 et seq. of the French Consumer Code, and for hidden defects under the conditions provided for in Articles 1641 et seq. of the French Civil Code.

    Under the legal warranty of conformity, the customer:

    • has two years from delivery of the piece to bring a claim;
    • may choose between repair and replacement, subject to the cost conditions provided for in Article L.217-12;
    • is relieved of the burden of proving the existence of the lack of conformity during the twenty-four months following delivery.

    The legal warranty of conformity applies independently of the ten-year commercial warranty granted by B.fabers.

    The customer may also rely on the warranty against hidden defects in the item sold, within the meaning of Article 1641 of the French Civil Code. In that case the customer has two years from the discovery of the defect, and may choose between rescission of the sale and a reduction in price, in accordance with Article 1644 of the French Civil Code.

    Article 10 — Ten-year commercial warranty

    Independently of the legal warranties set out in Article 9, B.fabers warrants each piece for ten years from delivery against any manufacturing or structural defect that makes the piece unfit for its use.

    The criterion is use, not appearance. This principle governs the whole of this article, and it deserves to be explained.

    What wood does, and what we do not consider a defect

    A piece of solid wood furniture is not an inert object. It responds to the humidity of the room in which it lives, to the seasons, to heating, to light, to everyday use. It acquires a patina, its shade changes, it bows slightly, surface checks and shrinkage cracks may appear. These movements are part of what we sell: they make the piece singular and tell its story. They are not covered by the warranty.

    The following are therefore not covered:

    • changes in shade, patina and marks of use;
    • shrinkage cracks, surface checks and micro-fissures that do not affect the strength of the piece;
    • a deformation that is visible to the eye but does not interfere with everyday use;
    • the gap that may appear under a large flat object placed on the surface, a serving tray for example, provided that object does not rock;
    • slight instability observed on an uneven or soft floor, which can be corrected with a shim.

    What is covered

    Anything that prevents the piece from fulfilling its function is covered, and in particular:

    • a joint that loosens, comes apart or fails;
    • the breakage or cracking of a load-bearing element;
    • a top whose deformation exceeds three millimetres under a one-metre straightedge, measured in any direction;
    • a top on which a flat-based object of ten centimetres or less, a glass, a bowl or a cup, rocks or wobbles, at any point;
    • a piece that rocks on a level floor, with a gap of more than three millimetres under one of its supports.

    These last three criteria can be checked without an expert: a rigid straightedge laid flat on the top and a shim to measure the largest gap, an everyday object, and a floor that has been confirmed to be level.

    The warranty then covers repair, on site or in the workshop depending on what is most appropriate, and failing that the replacement of the element or of the piece.

    What excludes the warranty

    Normal wear; impact; modification or repair by a third party; moving the piece without proper care; lack of maintenance; wall installation not in accordance with the instructions supplied, in particular fixing to a plasterboard partition without reinforcement.

    Also excluded is damage resulting from unsuitable ambient or usage conditions, whether prolonged or occasional:

    • humidity lastingly below 40% or above 65%;
    • an unheated or damp room, or one subject to large temperature swings;
    • proximity to a heat source, or direct exposure to sunlight;
    • exposure to rain, snow or frost;
    • prolonged standing liquid on the piece;
    • any period outdoors, however brief, and any use in an unenclosed space.

    A single exposure is enough to damage a piece of solid wood furniture lastingly: the brevity of an exposure does not bring the damage within the warranty.

    In case of doubt

    Write to us at maison@bfabers.com, with photographs. We look at each situation individually and, where the line is unclear, we decide it in favour of use: as soon as a piece no longer properly fulfils its function, we step in.

    Beyond these ten years, B.fabers continues to provide maintenance and restoration of the piece, on quotation.

    In accordance with Article L.217-15 of the French Consumer Code, this commercial warranty does not affect the legal warranties set out in Article 9, which B.fabers remains bound to apply in all circumstances.

    Article 11 — Personal data

    The processing of personal data is described in the privacy policy, accessible from the footer of the website.

    Article 12 — Consumer mediation

    In accordance with Articles L.612-1 and L.616-1 of the French Consumer Code, the customer may refer a dispute free of charge to a consumer ombudsman with a view to an amicable settlement, after having sent a written complaint to B.fabers and in the absence of a satisfactory reply within two months.

    Article 13 — Governing law and disputes

    These terms and conditions of sale are governed by French law.

    In accordance with Regulation (EC) No 593/2008 (Rome I) and Regulation (EU) No 1215/2012 (Brussels I recast), a consumer residing in another member state of the European Union retains the benefit of the mandatory protective provisions of the law of their country of residence, and may bring proceedings before the courts of that country.

    Failing an amicable settlement, the dispute is brought before the competent court.

    Article 14 — Intellectual property

    The designs, texts, photographs, trademarks and names of the pieces are the property of B.fabers or of its partners. The sale of a piece does not transfer any intellectual property rights.

    Article 15 — Use of the website and relationship with Shopify

    Access to and use of the website are for personal use only. The website may contain links to third-party sites, over whose content and practices B.fabers has no control and access to which is the user's responsibility.

    B.fabers is powered by Shopify, which enables us to provide you with the Services. However, any sale or purchase made in our store is made directly with B.fabers. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of the sales between you and B.fabers, including any damage, harm or loss arising from the products or services purchased. You hereby expressly release Shopify and its affiliates from any claim, damage and liability arising out of or in connection with your purchase and your transaction with B.fabers.

    These terms and conditions of sale entirely replace the terms of service previously published on the website.

    Article 16 — Language

    This English text is a translation provided for convenience. In the event of any discrepancy between the two versions, the French version prevails. This does not affect the mandatory rights available to consumers under the law of their country of residence.
